Procedures to obtain criminal record certificate (police clearance certificate/ judicial record certificate/ police check/ police certificate) in Vietnam
Procedures to obtain criminal record certificate (also called judicial record certificate/ police check/ police certificate/ police clearance certificate) in Vietnam is regulated in the Law no. 28/2009/QH12 of National Assembly of Vietnam on Judicial Record.
Criminal record certificate/ judicial record certificate/ police check/ police certificate/or police clearance certificate means a certificate/ card issued by an agency managing the criminal record database and valid to prove whether or not an individual has a previous criminal conviction, is banned from holding certain posts, establishing or managing enterprises or cooperatives in case enterprises or cooperatives have been declared bankrupt by court.
Agencies managing the criminal record database include the National Center for Criminal Record (NCCR)- Ministry of Justice and provincial-level Justice Departments. NCCR shall issue criminal record certificates to the following persons: (i) Vietnamese citizens whose places of permanent or temporary residence are unidentifiable; (ii) Foreigners who resided in Vietnam. Provincial-level Justice Departments shall issue judicial record cards to the following persons: (i) Vietnamese citizens permanently or temporarily residing in Vietnam; (ii) Vietnamese citizens currently residing overseas; and (iii) Foreigners currently residing in Vietnam.
Vietnamese citizens and foreigners who resided or are currently residing in Vietnam may request the issuance of criminal record certificates. A requester for a criminal record certificate shall submit a declaration requesting the issuance thereof enclosed with the following papers: (i) A copy of his/her identity card or passport; (ii) a copy of his/her permanent or temporary residence card.
Individuals may authorize other persons to carry out procedures for requesting the issuance of criminal record certificate (the certificate No.1). The authorization must be established in writing under law.
Foreigners residing in Vietnam shall submit their declarations to provincial-level Justice Departments in localities where they reside. In case they have left Vietnam, their declarations shall be submitted to the National Center for Criminal Records (NCCR).
The time limit for issuance of a criminal record certificate for a foreigner is 15 days after the receipt of a valid request.
Criminal record database-managing agencies may refuse to issue criminal record certificate in case papers enclosed with declarations requesting criminal record certificates are insufficient or forged.

Updated procedures for foreigners who resided in Vietnam to obtain a police certificate
Police certificate/ criminal record/ police check for foreigners who resided in Vietnam shall be issued by the National Center for Criminal Records (NCCR)- Ministry of Justice of Vietnam in Hanoi at No.9 Tran Vi Street, Mai Dich Ward, Cau Giay District, Hanoi.
How to apply
You may either:
(i) directly go to NCCR in Hanoi to apply in person, or
(ii) apply through postal service, or
(iii) authorize another person to represent you to apply for and to receive your police certificate at NCCR (if you want to apply for police certificate No.1).
If you want to apply for police certificate No.1, we recommentd that you choose option (iii) to reduce the cost and the risk of your application being rejected.
In case you authorise another person to represent you to apply for your police certificate, the application includes:
– The power of attorney which you authorize another person to apply police certificate for you;
– A written application for issuance of your police certificate signed by your authorized person on your behalf;
– A copy of your passport (certified true copy);
– A copy of your temporary residence card for the time living in Vietnam (certified true copy);
In case you want to apply for police certificate No.2, we recommentd that you apply through postal service with professional’s support.
Time limit for issuance of police certificates
The time limit for issuance of your police certificate is 15 days from the date NCCR received a valid request.
Refusal to issue police certificates
NCCR may refuse to issue the police certificate in case papers enclosed with your application are insufficient or forged. In that case, NCCR shall send you a written notice, clearly stating the reason.
